Terms of Service
DRAFT, needs legal review. Not in force. Placeholders in [brackets] must be filled in. Written for a US audience; if the business is based in the EU/DACH, GDPR and local rules (e.g. an Impressum) apply and this must be adapted.
Last updated: [date]. These terms apply between you and [legal entity name, address] ("we") when you buy a Leakcade check.
1. The service
For a one-time fee of $19 (USD) we run an automated, AI-assisted review of one public GitHub repository you name and email you a report. The review uses open-source scanners and an AI model. It is a first-pass review, not a security audit, penetration test or certification.
2. Your repository
- You confirm you're allowed to have the repository reviewed (you own it or have permission).
- We only accept public GitHub repositories. We don't execute your code.
- We may decline a check (for example repos over our size limit, or abusive use). Declined paid checks are refunded.
3. Disclaimer of warranties
Leakcade is an automated check. It uses open-source scanners and, in the $19 report, an AI model. It can miss vulnerabilities, report problems that aren't real, and suggest fixes that are wrong. A clean report does not mean your code is secure. Leakcade is not a substitute for a professional security audit, code review or penetration test.
The service, the reports and the fix prompts are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.
You remain responsible for your code, your app, your data and every change you make, including changes based on our fix prompts. Review each change and test it before you ship it.
4. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim related to a check is limited to the amount you paid for that check ($19, or $0 for a free scan). We are not liable for indirect, incidental, special or consequential damages, including lost profits, lost data, or security incidents in your software, even if we were told they were possible.
Some states, including New Jersey under its consumer protection laws, may not allow some of these limits or exclusions. Where that's the case, they apply only as far as the law allows, and nothing in these terms limits rights you have under laws that can't be waived. [Legal review: confirm wording against the NJ Consumer Fraud Act and the Truth-in-Consumer Contract, Warranty and Notice Act (TCCWNA), N.J.S.A. 56:12-14 to 56:12-18.]
5. Payments and refunds
Payments are processed by Stripe. Refunds follow our refund policy.
6. Acceptable use
Don't use the service to scan repositories you have no right to have reviewed, to overload it, or to attack it (including through content in a repository).
7. Changes and contact
We may update these terms; the version in effect when you buy applies to that purchase. Governing law: the State of New Jersey, USA [legal review: confirm entity, venue and governing law]. Contact: hello@leakcade.com.
